Introduction

These terms of service constitute a binding agreement between you and Dash Forms. ("dash forms”, “dashforms.xyz “, “we” or “us”). They set out the terms on which you may make use of our website and services as a guest or a registered user. The term “use” includes accessing, browsing, registering to use and using our site or API (Application Program Interface) interfaces. By using our site, you confirm that you accept these Terms of service and that you agree to comply with them and agree to abide by all the policies in the Acceptable Use Section. If you do not agree you must not use our site or any services offered by us.

However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, or any content on it, will be free from errors or omissions.

Your account and password

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of service. Intellectual property rights

We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours. We do not pre-screen Content, but we have the right and sole discretion to refuse or remove any Content that is available via our services.

Malware

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored, or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack.

We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately and you will be liable to us for any direct or indirect loss or damage we suffer because of or in connection with your breach.

Linking to our site

You may link to our site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association with us or approval or endorsement on our part where none exists.

You must not establish a link to our site on any website that is not owned by you. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the homepage. You may not use any meta tags or any other hidden text utilising our name or trademarks without our express written consent. We reserve the right to withdraw linking permission without notice. Acceptable use

The website in which you are linking must comply in all respects with the Content Standards set out below. Prohibited uses You may use our site and services only for lawful purposes. You may not use our site:

  • If you are registering “bots” or other automated methods
  • If you falsify information during the registration process
  • In any way that breaches any applicable local, national or international laws, regulations or legal orders or decisions
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
  • For the purpose of harming or attempting to harm minors in any way
  • To send, receive, upload, download, share, use or re-use any material which does not comply with our Content Standards
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam) or
  • To transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any website, software or hardware.

Content Standards

These content standards (“Content Standards”) apply to any and all material which you contribute to our site (“contributions”), and to any interactive or non-interactive services associated with it. You must comply with the spirit and the letter of the Content Standards as set out below. The Content Standards apply to each part of any contribution as well as to its whole.



Contributions must:

  • Be accurate (where they state facts).
  • Be genuinely held (where they state opinions).
  • Comply with applicable law from which country they are posted.


Contributions must not:

  • Contain any material which is defamatory of any person.
  • Contain any material which is obscene, offensive, hateful or inflammatory.
  • Promote sexually explicit material.
  • Promote violence or abuse.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, design, database right, trademark, patent or other intellectual property rights of any person.
  • Be misleading, inaccurate, fraudulent or likely to deceive any person.
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal activity.
  • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
  • Give the impression that they emanate from us if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
  • Attempt to gain unauthorised access to our site or any user's account or contributions.

Suspension and termination

We will determine, at our discretion, whether there has been a breach of this Acceptable Use Policy through your use of our site and services. When a breach of this Acceptable Use Policy has occurred, we may take such action as we deem appropriate. Failure to comply with this Acceptable Use Section constitutes a material breach of the Terms of service upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site or services.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site and services.
  • Issuing you with a warning.
  • Initiating legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Taking further legal action against you in respect of any direct or indirect loss or damage suffered as a result of or arising from the breach.
  • Disclosure of such information to law enforcement authorities as we feel is reasonably necessary.
